Marijuana Charges in Minnesota
Our state's marijuana laws, as with the rest of the state's drug laws, are contained in Chapter 152 of the Minnesota Statutes. According to this statute, marijuana is classified as a Schedule I Controlled Substance. There are two primary marijuana crimes that one can be charged with, and these are possession and
sales. The penalties for possession charges are:
- Up to $200 in fines and possible drug education classes for less than 42.5 grams
- Up to $10,000 in fines and 5 years in prison for 42.5 grams to 10 kilograms
- Up to $250,000 in fines and 20 years in prison for 10 to 50 kilograms
- Up to $500,000 in fines and 25 years in prison for 50 to 100 kilograms
- Up to $1,000,000 in fines and 30 years in prison for 100 kilograms or more
- Up to $1,000 in fines and up to 1 year in prison for more than 1.4 grams in a motor vehicle
The penalties for sales charges are:
- Up to $200 in fines and possible drug education classes for distribution of less than 42.5 grams without remuneration
- Up to $10,000 in fines and 5 years in prison for less than 5 kilograms
- Up to $250,000 in fines and 20 years in prison for 5 to 25 kilograms
- Up to $500,000 in fines and 25 years in prison for 25 to 50 kilograms
- Up to $1,000,000 in fines and 30 years in prison for 50 kilograms or more
- Up to $1,250,000 in fines and 35 years in prison for 50 kilograms or more imported into the state
- Up to $250,000 in fines and 20 years in prison for sale to a minor
- Up to $100,000 in fines and 15 years in prison for sale within a school zone and other specified locations
